These Terms of Service (“ToS”) govern the use of web hosting, cloud hosting, and email hosting services (collectively, “Services”) provided by Decasix (“we,” “us,” or “our”). By purchasing or using our Services, you (“Customer,” “you,” or “your”) agree to comply with these terms.

1. Acceptance of Terms

By purchasing and using any of our Services, you agree to be bound by these ToS, our Privacy Policy, Acceptable Use Policy, and any other policies or agreements incorporated herein by reference. If you do not agree to these terms, you may not use our Services.

2. Services Overview

We offer a variety of hosting services, including:

  • Web Hosting: Shared or dedicated hosting for websites.
  • Cloud Hosting: Scalable hosting solutions for applications and websites.
  • Email Hosting: Managed email solutions for businesses and individuals.

Each service may have its specific features, limitations, and pricing models, which are outlined on our website and in your customer account.

3. Account Registration

To access and use our Services, you must create an account with accurate and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for any activities or actions taken under your account.

3.1. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to use our Services. By registering an account, you represent that you meet this eligibility requirement.

4. Payment and Fees

4.1. Service Fees

You agree to pay all fees for the Services you purchase, as outlined on our website and during the checkout process. Fees may include but are not limited to, setup fees, monthly or annual hosting fees, and additional charges for optional services.

4.2. Billing

All services are billed in advance regularly (monthly, annually, or otherwise, depending on the service). If payment is not received by the due date, we reserve the right to suspend or terminate your services.

4.3. Late Payments

If your payment is overdue, we may charge a late fee and/or suspend your account until the outstanding balance is paid in full. If your account remains unpaid for more than [Insert number] days, it may be permanently terminated.

5. Refund Policy

Please refer to our Refund Policy for detailed information on refunds. As a general rule, no refunds are provided except in cases of account violations as described in the Refund Policy.

6. Acceptable Use

You agree to use our Services only for lawful purposes. You must not engage in any activities that:

  • Violate any applicable local, state, national, or international law or regulation.
  • Infringe on any third party’s intellectual property rights.
  • Interfere with, disrupt, or damage our servers or networks.
  • Engage in spamming, phishing, or distributing malware.
  • Use excessive server resources that negatively affect the performance of our infrastructure (as defined in our Resource Usage Policy).
6.1. Prohibited Activities

The following activities are strictly prohibited:

  • Hosting or transmitting illegal content, including child pornography, pirated software, and copyrighted material without permission.
  • Sending unsolicited bulk emails (SPAM).
  • Hosting phishing sites, hacking tools, or any other malicious software.

7. Resource Usage and Overcharge Fees

7.1. Web Hosting Usage

Web hosting accounts are subject to resource limitations (such as CPU, RAM, bandwidth, and storage). If you exceed the resource limits of your hosting plan, you will be charged overage fees based on our standard pricing for additional resources, which are outlined on our website or in your service agreement.

  • CPU/RAM Overuse: If you use more CPU or RAM than allocated in your plan, you will not be charged for any additional usage.
  • Bandwidth Overuse: If your bandwidth consumption exceeds your plan’s limits, overage charges of $0.2 per GB will apply.
  • Storage Overuse: Additional storage usage beyond the plan’s limit will be billed at $0.03 per GB.
7.2. Cloud Hosting Usage

Cloud hosting services are scalable, and you will be billed based on your actual resource consumption. If your usage exceeds the predefined limits or resource allocation, overcharge fees will apply as follows:

  • CPU, RAM, Bandwidth: Charges will be applied automatically at the rate outlined in your service agreement or on our website, based on the extra resources used.
  • Storage: Excess storage will be billed at $0.03 per GB over the allocated limit.
7.3. Email Hosting Usage

Email hosting services come with limitations such as mailbox size and email sending limits. If you exceed these limits, overcharge fees will apply:

  • Mailbox Storage: Additional mailbox storage will be charged at $0.03 per GB.
  • Excessive Email Sending: Sending more emails than allowed in your plan will result in an overage fee of $0.1 per 1,000 emails.
7.4. Overuse Notification

You will receive a notification via email when your account approaches or exceeds its resource limits. However, failure to receive this notification does not exempt you from overage charges.

8. Data Security and Backups

We take reasonable measures to ensure the security of your data. However, you are responsible for maintaining your backups of any data hosted on our servers. We are not responsible for data loss or corruption.

8.1. Backups

For web and cloud hosting services, we may provide automated backups as an add-on service. However, it is your responsibility to ensure that your backups are working correctly and stored securely.

9. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our Services at any time with or without notice. We will make reasonable efforts to notify you of any significant changes to your service that may impact your use.

10. Suspension and Termination

10.1. Account Suspension

We reserve the right to suspend your account if you violate any part of these ToS, fail to make timely payments or engage in any prohibited activities. In such cases, we will notify you of the suspension and the actions needed to restore service.

10.2. Termination

Your account may be terminated if:

  • You fail to resolve issues leading to suspension within 7 days.
  • You violate our Acceptable Use Policy repeatedly.
  • Your account remains unpaid for more than 7 days.

Upon termination, all data hosted in your account will be permanently deleted. It is your responsibility to backup any data before termination.

11. Intellectual Property

All content, software, and materials provided by Decasix are protected by intellectual property laws. You may not reproduce, distribute, or modify any part of our Services without prior written consent.

12. Limitation of Liability

To the maximum extent permitted by law, Decasix shall not be liable for any direct, indirect, incidental, or consequential damages arising out of or related to your use or inability to use our Services, including but not limited to loss of data, profits, or business interruptions.

13. Indemnification

You agree to indemnify and hold Decasix, its employees, and affiliates harmless from any claims, damages, or legal expenses arising from your use of the Services or violation of these TOS.

14. Governing Law

These Terms of Service are governed by the laws of India, without regard to its conflict of laws principles. Any legal action or proceeding related to these terms shall be brought in a court of competent jurisdiction in India.

15. Changes to the Terms of Service

We reserve the right to modify these TOS at any time. Any changes will be posted on our website, and it is your responsibility to review these terms periodically. Continued use of the Services after any changes indicates your acceptance of the new terms.
