  2. Performance Optimization: Tools for optimizing website speed, including caching, database optimization, and server-side tuning.
  3. Automatic Backups: Regular automated backups to ensure that your website data is protected and easily restorable.
  4. Free SSL Certificates: SSL certificates are provided free of charge for your website’s security and SEO ranking improvements.
  5. Advanced Security Features: Web application firewall, DDoS protection, malware scanning, and other security protocols to protect your website.
  6. 24/7 Customer Support: A support team is available round-the-clock to address any technical issues, queries, or service disruptions.

3. Service Availability and Maintenance

While Decasix strives to provide continuous and uninterrupted service, we cannot guarantee 100% uptime. You agree that Decasix may need to perform scheduled maintenance or experience downtime due to unforeseen issues, network failures, or technical issues.

  • Scheduled Maintenance: Decasix will provide notice of scheduled maintenance at least 48 hours in advance, whenever possible. During this time, some or all of the Services may be temporarily unavailable.
  • Unscheduled Maintenance: In the event of an emergency or critical issue requiring immediate attention, Decasix may perform unscheduled maintenance without prior notice.
  • Uptime Guarantee: Decasix makes a best-effort commitment to maintain a minimum 99.5% uptime. Any failure to meet this guarantee will be subject to the terms of our Service Level Agreement (SLA), which can be found on our website.

4. User Account Responsibilities

You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to:

  1. Account Information: Provide accurate and complete information when creating an account with Decasix. You are responsible for ensuring that your contact and billing information is kept up to date.
  2. Security of Credentials: Keep your login credentials confidential and secure. You are solely responsible for any activities that occur under your account.
  3. Account Management: You must ensure that your account is used in compliance with these Terms. Decasix is not responsible for any activities that occur under your account, whether authorized or unauthorized.
  4. Reporting Issues: You agree to immediately notify Decasix of any unauthorized use of your account or any other breach of security.

Failure to comply with these responsibilities may result in account suspension or termination at Decasix’s sole discretion.

5. Acceptable Use Policy

You agree not to use Decasix’s Services for any unlawful or prohibited purposes. This includes but is not limited to:

  1. Malicious Content: Hosting, distributing, or transmitting viruses, malware, spyware, or any other malicious software that can harm or disrupt other systems, networks, or users.
  2. Illegal Activities: Engaging in activities such as hacking, fraud, spam, phishing, or any illegal conduct that could result in harm to others.
  3. Excessive Resource Use: Using the Services in a way that negatively impacts the performance or availability of the system for other users. This includes but is not limited to, excessive CPU or memory usage.
  4. Infringement of Intellectual Property: Hosting or distributing content that violates the intellectual property rights of others.

Decasix reserves the right to monitor the use of its Services and may suspend or terminate accounts found to violate this Acceptable Use Policy.

6. Payment Terms

You agree to pay all fees associated with your use of Decasix’s Services.

  1. Billing Cycle: Payments for Services are typically billed on a pay-as-you-go basis.
  2. Late Payments: If you fail to make a payment by the due date, Decasix reserves the right to suspend or terminate your account. You may also incur a late fee.
  3. Fee Adjustments: Decasix may adjust fees for Services at any time, but will notify you of any changes at least 30 days prior to the adjustment.
  4. Payment Methods: Accepted payment methods include credit cards, bank transfers, or any other payment method offered by Decasix.

Failure to make payment within the prescribed period may result in service suspension, loss of data, and permanent termination of your hosting account.

7. Data Protection and GDPR Compliance

Decasix is committed to protecting the privacy and security of your data. As part of the Services, we may process personal data on your behalf by applicable data protection laws, including the General Data Protection Regulation (GDPR).

  1. Data Processor and Data Controller: Decasix acts as a data processor in relation to the personal data you store on our hosting infrastructure. You, the customer, are the data controller, and it is your responsibility to ensure that any personal data you collect complies with applicable laws.

    • Account Data: Name, email address, billing information, and other personal details collected during the account creation and billing process.
    • Website Data: Any personal data contained in content uploaded to your WordPress website, such as user data or interaction data.

8. Intellectual Property

Decasix retains all intellectual property rights related to the Decasix platform, services, and any associated software. You agree not to copy, modify, distribute, or otherwise infringe upon Decasix’s intellectual property.

  1. Your Content: You retain ownership of all content that you upload or create on your WordPress site hosted with Decasix. However, you grant Decasix a license to use, store, and display this content as necessary to provide the Services.
  2. License Grant: You grant Decasix a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute the content you upload as needed to provide the hosting and related services.

9. Limitation of Liability

To the maximum extent permitted by law, Decasix shall not be liable for any indirect, special, incidental, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of the use of or inability to use the Services.

  1. Limitation of Damages: In no event shall Decasix’s liability exceed the amount you paid for the Services during the twelve (12) months preceding the event giving rise to the claim.
  2. No Responsibility for Third-Party Services: Decasix is not responsible for any services or products provided by third parties, including plugins, themes, or external content.

10. Indemnification

You agree to indemnify, defend, and hold harmless Decasix and its affiliates, employees, officers, and agents from any claims, damages, losses, and liabilities (including legal fees) arising from:

  1. Your use of the Services
  2. Your violation of these Terms
  3. Any content you upload or host on the Services that infringes on the intellectual property rights of others

11. Termination

Either party may terminate this agreement at any time, with or without cause, by providing written notice to the other party. Upon termination:

  1. Data Deletion: You will be responsible for downloading or otherwise retrieving any data from your account before termination. Decasix will not be responsible for any data loss after termination.
  2. Outstanding Fees: You must pay any outstanding fees for the Services before termination can be completed.

Decasix reserves the right to suspend or terminate your account if you breach these Terms.

12. Miscellaneous

  • Force Majeure: Neither party will be held responsible for any delay or failure in performance caused by circumstances beyond their control.
  • Entire Agreement: These Terms constitute the entire agreement between you and Decasix.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
